Supreme Court has just now ruled that a teenager from Gujarat who got pregnant due to unwanted sex can appeal for abortion, but only if it saves her life.
After this 14 yr old girl was raped, the issue of her undergoing an abortion came under scrutiny because the pregnancy had already exceeded the legal period of 20 weeks. But now the court has said that she will be examined by a panel of doctors in Ahmedabad on July 30.
Earlier her gynecologist said, “When I examined and talked to her, I found her mentally and psychologically devastated and completely broken down. She is also physically and medically too weak to deliver a child. Pregnancy at this age and situation can lead to serious threat to her life.”
On July 24, the High Court had refused permission for termination of pregnancy, saying the baby was innocent and “did not ask to be born”. Moreover, her pregnancy was in the 24th week.
However, Justice Abhilasha Kumari had mentioned, “Whatever be the circumstances in which the child was conceived, whatever the trauma of the young mother, the fact remains that the child is also not to blame for being conceived.”
